מסמך משפטי. רישום שותפות. תיארוך: 1085 (על פי כרטיסיות גויטיין). נכתב ככל הנראה בידי הלל בן עלי (לפי גויטיין). המסמך הוא סופה של הצהרת שכיב מרע, שבה האיש הגוסס עורך חשבון של הנכסים המגיעים לשותפות בבית יציקה לעופרת. ככל הנראה החזיק הגוסס פנקס חשבונות; חלק מהנכסים היו מוחזקים במשותף בינו, בין אחיו אבו עלי ובין אדם בשם אבו אלח'יר, ואילו נכסים אחרים (ובהם תביעה כלפי אדם בשם יאקות על סך 11.5 דינרים) היו מוחזקים רק בינו לבין אבו אלח'יר. אף שייתכן שאבו אלח'יר לא היה השותף הפעיל היחיד, המסמך מצהיר עליו כנאמן בענייני רווח והפסד — ניסוח המופיע לעיתים קרובות ביחס לשותף הפעיל בשותפויות מסחר למרחקים. אפשר שהגוסס נאלץ לוותר על חלק מן השליטה בעסק בימיו האחרונים בשל מחלתו. מותו נרשם בשורות 9–10. אף שמיתת שותף היא תנאי מספיק לסיום שותפות הן במשפט העברי והן במשפט המוסלמי, סעיפי הסיום הרגילים אינם מופיעים כאן. תחת זאת נקבע שאחיו של הגוסס יבוא במקומו והשותפות תימשך, דבר המרמז על אופי תאגידי-למחצה של השותפות, הניתנת להעברה או להורשה. Princeton Geniza Project description: Legal document. Partnership record. Dating: 1085 (per Goitein's index cards). Written in the hand of Hillel b. Eli (probable, per Goitein). This document is the end of a deathbed declaration in which the dying man accounts for the assets due a partnership in a lead foundry. Apparently the dying man kept an account book; while some assets were held jointly between the dying man, his brother Abū ‘Alī, and one Abū al-Khayr, other assets (including a claim against someone named Yāqūt for 11.5 dinars) were held only between the dying man and Abū al-Khayr. Although Abū al-Khayr may not have been the sole active partner, the document declares trustworthy concerning profit and loss, a phrase often applied to the active partner in a long-distance partnership. Perhaps he had to relinquish some control of the enterprise in his final days as he was ill. His death is recorded on lines 9-10. Although the death of a partner is a sufficient condition for termination of a partnership in Jewish and Islamic law, the typical termination clauses are absent. Rather, the dying man’s brother is to take his place and the partnership is to continue, suggesting an inheritable or transferable, quasi-corporate aspect to the partnership. T-S 8J21.14 + T-S 8J8.12 (PGPID 7679) and T-S 12.606 (PGPID 3187) are a likely (noncontinuous) join; both refer to the same sum of 7.25 dinars owed by Yāqūt. ASE
