תיאור
רישום מבית הדין בכתב ערבי, ככל הנראה טיוטה. עוסק בירושת המנוחה סִתָּאת בת עבדאללה. המסמך נערך בקירואן, על סמך השיקולים הבאים: (1) שיקולים פלאוגרפיים המעידים על סופר צפון-אפריקאי: חלק מאותיות הקאף נושאות נקודה אחת מעל, וחלק מאותיות הפאא' נושאות נקודה אחת מתחת. (2) העובדה שהצד השני (verso) נוצל מחדש (בסיבוב של 90 מעלות) עבור כתובת על מכתב מנהראי בן נתן אל בן דודתו (אבן עמה) נהראי בן נסים (שמוצאו מקירואן והיגר למצרים סביב 1040 לספירה). דבר זה מתארך את המסמך למאה החמישית להג'רה / האחת-עשרה לספירה. (3) העובדה שהמסמך מציין פעמיים (שורות 2 ו-3) שהחורבה ניצבת בבאב עבדאללה, "בג'ואר באב אלקלאלין" (בجوار باب القلالين, ולא بجوار باب الفلالين כפי שקרא ח'אן), כלומר "בקרבת שער היוצרים" (אצל קזימירסקי "qillāl" משמעו "כד חרס"). בספרו של אלבכרי "כתאב אלמסאלכ ואלממאלכ" (כרך 2, עמ' 676) מוזכר באב אלקלאלין בקירואן וכן באב עבדאללה, אחד השערים המזרחיים הקדומים ביותר בקירואן, הסמוך למסגד הגדול ולא הרחק מבאב אלקלאלין. בסך הכול, מדובר נכון להיום (דצמבר 2024) במסמך המשפטי הערבי הקדום ביותר ששרד מקירואן. שלוש השורות שבתחתית הצד הראשון (recto) כתובות בכתב יד שונה מזה של גוף המסמך, אך גם הוא צפון-אפריקאי. המסמך מספק הצצה מעניינת לנוהגי תיוק וארכיון של בית הדין: "לאחר מכן נפטר השופט ושופט אחר תפס את מקומו. הוא בחן את הארכיון (דיואן) של השופט המנוח ומצא שהכסף היה רשום בו" (שורה 11). בנוסף לכתובת, מופיעה בצד השני גם הערה דהויה בכתב ערבי (...الحق (؟) لذلك في دار بو (؟)).
Princeton Geniza Project description: Court record in Arabic script, maybe a draft. Concerning the inheritance of the late Sittāt bt. ʿAbdallāh. This document was drawn up in Qayrawān, based on: (1) paleographic considerations that indicate a North African scribe: some qāf-s have a single dot above while some fāʾ-s have a single dot beneath. (2) the fact that the verso was reused (at 90º) for the address of a letter from Nahray b. Natan to his cousin (ibn ʿamma) Nahray b. Nissim (who was originally from Qayrawān and migrated to Egypt around 1040CE). This places the document in the 5th/11th century. (3) the fact that the document mentions twice (l. 2 and 3) that the ruin stands at bāb ʿAbdallāh, بجوار باب القلالين (and not بجوار باب الفلالين as read by Khan), that is "by the neighborhood of the gate of the potters" (Kazimirski has "cruche en terre" for qillāl). In the Kitāb al-Masālik wa-l-mamālik (2: 676), al-Bakrī mentions a bāb al-qallālīn in Qayrawān as well as the bāb ʿAbdallāh, which is one of the earliest Eastern gates of Qayrawān not far from the Great Mosque, near the bāb al-qallālīn. All in all, this document is for now the earliest extant Arabic legal document from Qayrawān (as of Dec 2024). The three lines at the bottom of recto are written in a different hand than the main document, also North African. The document contains an interesting glimpse into judicial archiving practices: "Subsequently the judge died and another judge assumed office. He examined the archive (dīwān) of the deceased (judge) and found that the money had been registered in it (l. 11). In addition to the address, there is also a faded note in Arabic script on the verso ((؟)...الحق (؟) لذلك في دار بو) (Information from Goitein's index cards and from Khan; emendations: AP)
