מסמך משפטי. עדות. מתוארך לסיון א'תע' לשטרות = מאי-יוני 1159. העדות עוסקת באירוסים בין תמים בן אבו אלפרג' לפח'ר בת יוסף, וקובעת קנס במקרה שיתברר כי קיים אצל תמים מכשול כלשהו המונע את הנישואין. הקטע חושף הסכם שותפות קצר-מועד בין ח'לף בן שמואל לברכאת בן מוסא אבן מוסכה, אשר תוקפו נקבע לשנה תמימה אחת. אף שהפרטים מועטים, נראה כי מדובר בשותפות פעילה משותפת הממוקמת במקום אחד, ולא בשותפות מסוג השקעה, שכן 1.3 דינרים מן הרווח נועדו להקצאה לטובת השותפות לכיסוי הוצאות הון משותפות, ויתרת הרווחים תחולק שווה בשווה בין שני השותפים. למרות שהשותפים אינם מתארים את הקשר ביניהם במונחים "שִׁרְכַּה", "מֻעַאמַלָה", "מֻצָ'ארַבָּה" או אפילו "שותפות", הם עושים שימוש בפועל מן השורש ש-ר-כ בבניין השמיני.

Princeton Geniza Project description: Legal document. Testimony. Dated: Sivan 1470 Sel. = May-June 1159 CE. Testimony around the engagement of Tamīm b. Abū al-Faraj and Fakhr bt. Yosef, imposing a penalty if Tamīm is found to have an impediment to the marriage. This fragment reveals a brief partnership agreement between Khalaf b. Samuel and Barakāt b. Mūsā Ibn Muska, the term of which is to be one full year. Although short on details, this would seem to have been a joint active partnership situated in a single location rather than an investment partnership, since 1.3 dinars of the profit are to be allocated for the partnership to cover joint capital expenses, the balance of which is to be split evenly between the two partners. Although the partners do not describe their relationship as a shirka, mu‘āmala, muḍāraba, or even shutafut, they do use the verb sh-r-k in Form VIII.
